Terms of Service

Last Updated: October 3, 2026

These Terms of Service, End User License Agreement, and Community Safety Standards ("Terms") govern your use of Wainkom, operated by Embur Inc. ("we", "us", or "our"). By creating an account or using Wainkom, you agree to these Terms. If you do not agree, do not create an account or use the App.

Zero Tolerance Community Standard

Wainkom has zero tolerance for objectionable content or abusive users. Reports of objectionable content or abusive behavior are reviewed and acted on within 24 hours. When a violation is confirmed, Wainkom will remove the offending content and eject the user who provided it.

1. Eligibility and Adult Access

You must be at least 18 years old to create an account or use Wainkom. By creating an account, you represent and confirm that you are 18 years of age or older and that all information you provide is accurate.

Wainkom may suspend or terminate an account if information provided during registration is inaccurate or if the account holder does not meet the minimum age requirement.

2. Account Registration and Acceptance

You are responsible for maintaining the confidentiality of your account credentials and for activity performed through your account. You agree to provide accurate information and keep it updated.

Registration requires your affirmative acceptance of these Terms, including the zero-tolerance policy and the Community Safety Standards described below. You cannot complete registration without accepting these Terms.

3. Zero Tolerance and User Conduct

Wainkom has zero tolerance for objectionable content and abusive users.

You agree not to:

Violations may result in immediate content removal, account restriction, suspension, permanent termination, and loss of access to Wainkom without refund, except where a refund is required by applicable law.

4. User-Generated Content

User-generated content includes messages, profile information, photos, and other material submitted, uploaded, transmitted, or shared through Wainkom.

You retain ownership of your content, but grant Embur Inc. a limited license to host, process, display, transmit, preserve, and review that content as reasonably necessary to operate, secure, and moderate the App. You remain responsible for the content you submit or share.

Wainkom may filter, restrict, remove, preserve, or review content to enforce these Terms, protect users, comply with applicable requirements, investigate reports, and maintain community safety.

Wainkom is based on private interactions between users and does not provide an unrestricted public posting feed. This does not reduce any user's obligation to comply with these Terms.

5. Content Filtering

Wainkom uses moderation controls designed to detect and filter objectionable text before it is stored or delivered. Users may not attempt to evade these controls through altered spelling, spacing, symbols, or other forms of obfuscation.

Automated filtering supplements, but does not replace, user reporting and human review. Content that passes an automated filter may still be removed if it violates these Terms or is determined to be harmful or abusive.

6. Reporting Objectionable Content and Abusive Users

Wainkom provides in-app controls that allow users to report objectionable content, abusive users, inappropriate profiles, and abusive behavior.

Users can report inappropriate activity through these controls:

Reports may include the reported user, the selected reason, the relevant message or profile information, and other information available to Wainkom for investigation, moderation, and enforcement.

Submitting knowingly false, retaliatory, misleading, or abusive reports may itself violate these Terms and may result in account action.

7. Blocking Abusive Users

Users can block another user from a conversation or from a Discovery profile. Reporting a user, message, or profile may also block the reported user from interacting with the reporting user.

Blocked users are restricted from interacting with or being shown to the user who blocked them, subject to the technical operation of the App.

A list of blocked users is available under Profile > Safety & Privacy > Blocked Users.

8. Immediate Removal of Your Own Messages

You can immediately remove a message you sent by pressing and holding your own message and selecting Delete.

Account deletion is available under Profile > Safety & Privacy > Delete Account.

Removing content from the user interface does not prevent Wainkom from preserving relevant information when reasonably necessary to investigate a safety report, prevent abuse, comply with applicable requirements, resolve a dispute, or enforce these Terms.

9. 24-Hour Moderation and Enforcement

We review reports of objectionable content or abusive behavior and act within 24 hours.

When a violation is confirmed, Wainkom will remove the offending content and eject the user who provided it. Enforcement may include immediate content removal, account restriction, suspension, permanent account termination, loss of access to the App, and measures intended to prevent further abuse.

Accounts may be temporarily restricted or suspended following moderator review when available evidence indicates a safety risk or violation of these Terms.

A report by itself does not automatically establish that a violation occurred. Wainkom may review the available content, evidence, reporting context, and account history before taking enforcement action.

Wainkom may preserve relevant records when reasonably necessary for safety, fraud prevention, enforcement, dispute handling, or compliance with applicable requirements.

10. Contact Support

Users can report inappropriate activity or ask for safety support directly from the App by visiting Profile > Safety & Privacy > Contact Support.

Safety reports can also be sent by email. Include enough information to identify the issue while avoiding unnecessary personal or confidential information.

Report inappropriate activity Email support@embur.world to report inappropriate activity or ask for safety support.

11. Location-Based Features

Wainkom's Radar and Navigate features rely on your device's location services. You are responsible for exercising reasonable caution when interacting with or meeting another user.

We recommend meeting in public places and informing a trusted person of your plans. Wainkom does not conduct background checks and cannot guarantee the identity, intentions, accuracy, or conduct of another user.

Wainkom does not display your exact location to other users. Approximate proximity information may be used to provide the App's location-based features.

12. Premium Subscriptions

Wainkom offers optional auto-renewing Premium subscriptions through Apple's In-App Purchase system, including Monthly and Annual plans.

Billing: Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.

Renewal: Your account will be charged for renewal within 24 hours before the end of the current period at the applicable subscription price, unless a change has been disclosed as required.

Managing and Cancelling: You can manage or cancel your subscription through your Apple ID subscription settings. Cancellation takes effect at the end of the current billing period. Partial refunds are not provided for unused subscription time except where required by applicable law.

Premium Features: Premium features may include Ghost Mode, expanded interaction limits, visibility into incoming interest, distance-related features, and Panic Hide. Features may be modified with appropriate notice.

Refunds: Purchases are handled by Apple. Refund requests must be submitted through Apple's purchase-support process.

13. Suspension and Termination

Embur Inc. may suspend or terminate an account, remove content, or restrict access when reasonably necessary to enforce these Terms, address fraud or abuse, respond to a safety report, protect users, or maintain community safety.

Enforcement decisions may take into account the available evidence, severity of the conduct, repeated violations, attempts to evade enforcement, risks to other users, and applicable legal or safety requirements.

A user may delete an account at any time through Profile > Safety & Privacy > Delete Account.

14. Disclaimers

Wainkom is provided "as is" without warranties of any kind to the extent permitted by applicable law. We do not guarantee matches, the accuracy of user profiles, or the conduct, intentions, or identity of another user.

You are responsible for exercising appropriate caution when communicating with or meeting another user.

15. Limitation of Liability

To the maximum extent permitted by applicable law, Embur Inc. will not be liable for indirect, incidental, special, or consequential damages arising from use of Wainkom, including interactions with other users.

Nothing in these Terms excludes or limits rights or liabilities that cannot lawfully be excluded or limited.

16. Changes to These Terms

These Terms may be updated from time to time. Material changes may be communicated through the App or another appropriate method.

Where renewed acceptance is required, you may be asked to accept the updated Terms before continuing to use affected features or creating a new account.

17. Governing Law

These Terms are governed by the laws of Kuwait, without regard to conflict-of-law principles, except where applicable consumer protection requirements provide otherwise.
