These Terms of Service ("Terms") constitute a legally binding agreement between you and Embur Inc. ("Embur", "we", "our", or "us") governing your access to and use of the Embur mobile application, website at embur.world, and all related services (collectively, the "Service").
By creating an account, accessing, or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service.
These Terms apply to all users of Embur, including creators, viewers, and businesses. Using Embur means you accept these Terms in full.
You must meet all of the following requirements to use Embur:
Embur complies with the Children's Online Privacy Protection Act (COPPA). We do not knowingly permit children under 13 to create accounts. If we discover a user is under 13, we will immediately terminate their account and delete all associated data.
You must provide accurate, complete, and current information when creating your account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
You may delete your account at any time from Settings → Delete Account. Account deletion is permanent. All your content will be removed immediately and all data permanently deleted within 30 days.
You retain ownership of content you create and post on Embur ("User Content"). By posting User Content, you grant Embur a non-exclusive, royalty-free, worldwide, transferable, sublicensable license to use, display, reproduce, distribute, and promote your content in connection with operating and improving the Service. This license ends when you delete your content or account.
You are solely responsible for your User Content. By posting, you represent and warrant that:
Users can report objectionable content or block abusive users via the three-dot menu on any post or profile. Reports are reviewed by our safety team. Embur reserves the right to remove any content that violates these Terms at any time without notice.
The Embur name, logo, app design, technology, and all associated intellectual property are owned by Embur Inc. and protected by copyright, trademark, and other laws. You may not use our branding without our prior written permission.
We respect intellectual property rights and expect users to do the same. If you believe your copyrighted work has been infringed on Embur, please send a DMCA takedown notice to:
Your notice must include: identification of the copyrighted work, description of the allegedly infringing content and its location on Embur, your contact information, a statement of good faith belief, and your signature.
You agree not to use Embur to:
Any user found sharing CSAM will be immediately and permanently banned. All evidence will be reported to the National Center for Missing and Exploited Children (NCMEC) CyberTipline and relevant law enforcement authorities. There are no exceptions.
Embur Credits ("Credits") are a virtual currency used to access AI Studio features within the app. Credits are purchased via PayPal at embur.world/credits.
All payments are processed by PayPal. By making a purchase, you agree to PayPal's Terms of Service and Privacy Policy. Embur does not store your payment card information. For billing disputes, contact support@embur.world.
Embur provides creators with multiple ways to earn, including virtual gifts from fans, reel view rewards, tip jars, and in-profile shops. By participating in creator monetization:
Embur's AI Studio features are powered by third-party AI services. By using AI features, you consent to your content being processed by these services as described in our Privacy Policy — Section 3A.
Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using Embur, you consent to our data practices as described in the Privacy Policy.
You may stop using Embur and delete your account at any time from Settings → Delete Account. Deletion is permanent and immediate.
We may suspend or permanently terminate your account, without notice, if you:
Upon termination, your right to use the Service immediately ceases. Content you posted may be removed. Unused Credits are forfeited upon termination for violations.
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. Embur does not warrant that the Service will be uninterrupted, error-free, or free of viruses or harmful components. We do not warrant the accuracy or completeness of any content on the Service.
To the fullest extent permitted by applicable law, Embur Inc. and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of profits, data, goodwill, or other intangible losses.
In jurisdictions that do not allow the exclusion of certain warranties or limitation of liability, our liability is limited to the maximum extent permitted by law.
These Terms are governed by the laws of the United States, where Embur Inc. is operated, without regard to its conflict of law provisions. For users in the European Economic Area, applicable EU consumer protection laws apply.
Before pursuing formal dispute resolution, we encourage you to contact us at legal@embur.world to resolve the issue informally. We will make a good-faith effort to resolve any dispute within 30 days.
For users outside the EEA, disputes that cannot be resolved informally shall be submitted to binding arbitration on an individual basis. Class action lawsuits are waived to the fullest extent permitted by law.
If you are located in the European Economic Area, you have the right to submit a complaint to your local data protection authority and may have additional rights under EU consumer protection law.
We may update these Terms from time to time. When we make material changes, we will:
